Skilled Migration is the most common means by which migrants enter
Australia. The recent economic downturn has prompted the Federal Government to changed this program to increase it’s reliance on “Employer Nominated” skilled migration. Employer nominated migration is where an Australian business, (unable to obtain skilled labour from the local labour market) will sponsor a migrant to enter
Australia while guarantying the migrant employment for a defined period.
Employer Nominated Skilled Migration can be either temporary or permanent, depending on the needs of the local business. Permanent residency is obtained through the “Regional Sponsored Migration Scheme” (RSMS). Temporary residency is provided through the “Temporary Business Long Stay” commonly called (457).
The Mid West Development Commission is the “Regional Certifying Body” (RCB) in the Mid West Region of WA for both RSMS and the 457 Skilled Migration programs. This means the Mid West Development Commission will review applications to check they meet the general principles of the program, and these are;

The position can not be filled locally
·
The position is offered to the local labour market first
·
The position is necessary to the business and full time
·
The conditions of the position do not ‘devalue’ the local labour market
·
The labour shortage is not of the business’s own making.
Using these principles the Mid West Development Commission has developed a number of policies to provide uniformity in its decision making. Our policies are;

Businesses must advertise all positions locally for at least one month.
·
Advertising must state the conditions and salary range of the position.
·
Advertising must be current to the application – not more than three months old.
·
The Commission will not review applications for permanent residency where the nominee is currently on a temporary business long stay visa, until that visa is about to expire.
·
The business has a training program and not reliant on Skilled Migration for labour.
